Terms of Service

These Terms of Service ("Terms") govern your use of the FoldPaper application ("the app"), developed and operated by Sisorop. By downloading, installing, or using FoldPaper, you agree to these Terms.

1. Description of Service

FoldPaper is an Android live wallpaper application that allows you to set dynamic wallpapers with depth effects, motion layers, and fold-reactive behavior. The app operates locally on your device.

FoldPaper is currently offered as a beta (pre-release) version. It is provided for testing and evaluation purposes, may contain errors, may behave unexpectedly, and may be changed, interrupted, or discontinued at any time. You should not rely on beta features for any critical purpose.

2. Permitted Use

You must be at least 16 years old to use FoldPaper. If you are younger, you may use the app only with the consent of a parent or legal guardian.

You may use FoldPaper for personal, non-commercial purposes on Android devices you own or control. You may:

• Set and customize live wallpapers using your own images
• Create and save presets and configurations

3. Prohibited Actions

You may not:

• Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the app
• Modify, adapt, or create derivative works based on the app
• Redistribute, sublicense, rent, lease, or lend the app to third parties
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the app for any unlawful purpose or in violation of any applicable laws
• Attempt to circumvent any security measures, licensing mechanisms, or access controls

The above restrictions apply only to the extent permitted by applicable mandatory law. In particular, your statutory rights to observe, study, or test the functioning of the software and to decompile it for interoperability purposes (§§ 69d, 69e of the German Copyright Act) remain unaffected.

4. Intellectual Property & User Content

FoldPaper, including its code, design, graphics, and documentation, is the intellectual property of Sisorop and is protected by copyright and other intellectual property laws. I do not claim any rights over images or content you import into the app. You are responsible for ensuring you have the necessary rights to use, and where applicable share, any images you import or export through the app.

5. Disclaimer of Warranties

FoldPaper is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

I do not warrant that:

• The app will be uninterrupted, error-free, or free of harmful components
• The app will be compatible with all devices or Android versions
• Wallpapers will display identically across all screen configurations

Nothing in these Terms excludes or limits any mandatory statutory warranty, conformity, or update rights you may have as a consumer under applicable law (including, where applicable, the rules on digital products in §§ 327 ff. of the German Civil Code). Such rights remain unaffected.

6. Limitation of Liability

FoldPaper is provided to you free of charge. The following limitations apply within the framework of, and without prejudice to, any mandatory statutory liability.

I am liable without limitation:

• for damages arising from injury to life, body, or health caused by a negligent or intentional breach of duty;
• for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit);
• for damages covered by a guarantee expressly given by me;
• insofar as liability is mandatory under the German Product Liability Act (Produkthaftungsgesetz) or other mandatory statutory provisions.

In the event of a slightly negligent breach of an essential contractual obligation — an obligation whose fulfilment is necessary for the proper performance of the contract and on whose observance you may regularly rely (a "cardinal obligation") — my liability is limited to the foreseeable damage typical for this type of agreement.

Any further liability is excluded. In particular, and to the maximum extent permitted by applicable law, I shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or device malfunction, arising out of or related to your use of the app, except in the cases expressly set out above.

The above limitations and exclusions also apply in favour of my legal representatives and vicarious agents (Erfüllungsgehilfen).

7. Third-Party Services

The app integrates third-party services (Google AdMob, Google ML Kit) that are subject to their own terms of service. Your use of these services is governed by their respective terms. I am not responsible for the practices of third-party service providers.

8. Updates and Changes

I may update the app from time to time to add features, fix bugs, or improve performance. I may also discontinue the app or any feature at any time without notice. These Terms may be updated; continued use of the app after changes constitutes acceptance of the updated Terms.

9. Termination

You may stop using the app at any time by uninstalling it. I reserve the right to restrict access to the app if these Terms are violated. Upon termination, your locally stored data remains on your device until you remove it.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer in the EU, you also retain the protection of mandatory consumer protection laws of your country of residence.

11. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
